1. Acceptance of Terms

By accessing or using the website located at CremationMatch.com (the “Site”), you agree to be legally bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease use of this Site.

These Terms apply to all visitors, users, registered businesses, and any other parties who access or use the Site in any capacity. “You” refers to the individual or entity accessing this Site. “We,” “us,” and “our” refer to CremationMatch.com LLC.

Your continued use of the Site following the posting of revised Terms constitutes your acceptance of those revisions.

2. Nature of the Service — Directory Only

CremationMatch.com is an online business directory that lists independently-owned funeral homes and cremation providers for the purpose of helping consumers locate local funeral service providers. The Site operates exclusively as a directory and marketing platform.

CremationMatch.com LLC:

• Does not provide funeral services of any kind
• Does not perform cremation services
• Does not handle, transport, or care for human remains
• Does not sell or arrange funeral merchandise
• Does not negotiate, mediate, or facilitate contracts between consumers and listed providers
• Does not collect payments on behalf of any listed provider
• Does not hold any funeral director’s license, crematory license, or other funeral industry license

All funeral, cremation, and related services are provided solely and exclusively by the independently-owned, third-party businesses listed in the directory. Any engagement with a listed provider — including but not limited to scheduling services, making payments, signing contracts, or arranging for the care of a deceased individual — is a transaction between you and that independent third party, not between you and CremationMatch.com LLC.

3. Disclaimer of Affiliation with Listed Providers

Listed providers are independent businesses that have applied for and paid for directory placement on this Site. CremationMatch.com LLC acts solely as a publisher of directory information. The relationship between CremationMatch.com LLC and any listed provider is that of a directory publisher and an advertiser — not employer/employee, principal/agent, partner, joint venturer, franchisor/franchisee, or any other relationship that would create vicarious liability.

CremationMatch.com LLC does not:

• Control how listed providers conduct their business
• Supervise, oversee, or direct any funeral services rendered by listed providers
• Guarantee the accuracy of pricing, availability, or service descriptions provided by listed providers
• Guarantee that any listed provider remains licensed, operational, or compliant with applicable law at the time you contact them
• Accept responsibility for any acts, omissions, negligence, or misconduct by any listed provider

You are solely responsible for independently verifying the credentials, licensing, pricing, and suitability of any provider you contact or engage through this directory. We strongly encourage you to request a written General Price List, confirm state licensing, and review any contract before making payment.

4. Terms for Listed Providers

Funeral homes and cremation providers that apply to be listed on this Site (“Providers”) agree to the following additional terms as a condition of listing:

4.1 Accuracy of Submitted Information

Providers represent and warrant that all information submitted for their listing — including business name, physical address, ownership structure, pricing, licensing status, and description — is accurate, current, and not misleading. Providers agree to promptly notify CremationMatch.com LLC of any material changes to this information.

4.2 Pricing Compliance

Providers represent and warrant that their listed direct cremation price is all-inclusive, reflects the actual price charged to consumers, and does not exceed $1,500 at the time of listing and throughout the term of their listing agreement. A “listed price” means the total price for the complete direct cremation service as described on the Site, with no additional mandatory fees beyond those disclosed.

4.3 Independent Ownership

Providers represent and warrant that they are independently or family-owned and are not owned by, affiliated with, or operating under franchise agreements with any corporate funeral chain, including but not limited to SCI / Service Corporation International, Dignity Memorial, Carriage Services, Foundation Partners Group, or NorthStar Memorial Group.

4.4 Licensing

Providers represent and warrant that they hold all required state and local licenses to operate a funeral home and/or crematory in their listed jurisdiction, and will maintain such licenses in good standing for the duration of their listing.

4.5 Indemnification by Providers

Providers agree to indemnify, defend, and hold harmless CremationMatch.com LLC, its members, officers, employees, and agents from any claims, losses, damages, liability, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) any inaccuracy in submitted listing information; (b) any funeral services provided by the Provider to any consumer; (c) any violation of applicable law by the Provider; or (d) any breach of these Terms by the Provider.

4.6 No Exclusivity Guarantee

CremationMatch.com LLC reserves the right to remove, suspend, or modify any listing at its sole discretion, including for failure to meet listing standards, receipt of credible consumer complaints, loss of licensing, or change in ownership. Payment of a listing fee does not guarantee uninterrupted listing or exclusive rights beyond the stated one-provider-per-city policy.

5. Limitation of Liability

This limitation applies regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise) and even if CremationMatch.com LLC has been advised of the possibility of such damages.

In no event shall CremationMatch.com LLC’s total liability to you for all claims arising from or related to the Site exceed the greater of (a) $100 USD or (b) the amount you paid to CremationMatch.com LLC in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above apply to the maximum extent permitted by law.

CremationMatch.com LLC expressly disclaims all warranties, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to the Site and any information contained herein.

6. User Conduct

By using this Site, you agree that you will not:

• Submit false, misleading, or fraudulent information through any form on the Site
• Use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to access, scrape, harvest, or copy directory data through automated means without prior written permission
• Interfere with or disrupt the operation of the Site or any servers or networks connected to the Site
• Impersonate any person, business, or entity
• Submit spam, unsolicited commercial communications, or misleading content
• Attempt to gain unauthorized access to any portion of the Site

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for conduct that we determine to be in violation of these Terms or harmful to other users, providers, or the integrity of the directory.

7. Accuracy of Information

CremationMatch.com LLC makes reasonable efforts to ensure that directory listings are accurate at the time of publication and annual re-verification. However, we do not guarantee the accuracy, completeness, currentness, or reliability of any information on the Site.

Pricing, availability, ownership status, licensing, and service descriptions are provided by listed funeral homes. CremationMatch.com LLC cannot guarantee that this information is accurate at the time you access it. Business conditions change. Prices may have changed since the last verification. Funeral homes may be sold, acquired, or closed.

Always verify information directly with any provider before relying on it for any purpose, and especially before making any payment or entering into any agreement.

8. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, design, layout, and code — is owned by or licensed to CremationMatch.com LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this Site without our prior written consent.

Providers grant CremationMatch.com LLC a non-exclusive, royalty-free, worldwide license to display, reproduce, and publish any information, descriptions, and content submitted for directory listing purposes.

9. Third-Party Links

This Site may contain links to third-party websites, including the websites of listed funeral home providers. These links are provided for convenience only. CremationMatch.com LLC has no control over the content, privacy practices, or accuracy of third-party websites, and we expressly disclaim any responsibility for them. A link to a third-party website does not constitute an endorsement, approval, or representation that CremationMatch.com LLC is affiliated with that website or its operator.

Your use of any third-party website is subject to the terms and privacy policies of that website, and you access such sites at your own risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless CremationMatch.com LLC and its members, officers, employees, agents, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) any information you submit through the Site; or (d) your violation of any applicable law, rule, or regulation.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any dispute arising under or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Oregon, and you hereby consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceeding, you agree to contact us in good faith to attempt to resolve the dispute informally. You agree to provide written notice of the dispute and allow thirty (30) days for us to respond and attempt resolution.

12. Changes to These Terms

CremationMatch.com LLC reserves the right to update or modify these Terms at any time in its sole discretion. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Site following any such changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If any modification is unacceptable to you, your sole remedy is to cease using this Site.
